Terms and Conditions

Welcome to Calk. These Terms and Conditions ("Terms") govern your use of the Calk mobile application ("App," "Service") operated by Calk ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Acceptance of Terms

By accessing or using Calk, you confirm that you are at least 13 years old (or 16 in the European Economic Area) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Calk is an AI-powered calorie tracking application that allows users to:

• Take photos of food for AI-based nutritional analysis
• Track daily calorie and macronutrient intake
• Set and monitor personalized nutrition goals
• View historical data and progress over time

The Service is currently available exclusively for iOS devices. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

3.1 Device-Based Authentication

Calk uses device-based authentication. This means your account is tied to your device identifiers rather than a traditional email/password combination. You are responsible for maintaining the security of your device.

3.2 Account Information

You agree to provide accurate and complete information when using the App, including your personal details used for calorie calculations (age, gender, height, weight, activity level). Inaccurate information may result in incorrect calorie recommendations.

4. Subscription and Payments

4.1 Free and Premium Features

Calk offers both free and premium (paid subscription) features. Free users have access to basic functionality, while premium subscribers enjoy additional features and unlimited AI scans.

4.2 Billing

Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to the App Store's terms of service. Subscription fees are charged to your Apple ID account at confirmation of purchase.

4.3 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's App Store settings.

4.4 Refunds

Refund requests are handled by Apple in accordance with the App Store's refund policies. We do not process refunds directly.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Upload malicious content, viruses, or harmful code
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Upload inappropriate, offensive, or non-food images for analysis
• Attempt to circumvent subscription requirements or payment systems

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, content, and underlying technology, is owned by Calk and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

6.2 Your Content

You retain ownership of any content (such as food photos) you upload to the App. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze this content solely for the purpose of providing the Service.

7. Disclaimers

7.1 AI Accuracy

IMPORTANT: Calk uses artificial intelligence to estimate nutritional information from food images. While we strive for accuracy, AI-based analysis is not perfect and may contain errors. The calorie and macronutrient values provided are estimates only and should not be considered as definitive nutritional facts.

7.2 Not Medical Advice

The Service is for informational purposes only and does not constitute medical, nutritional, or health advice. Calk is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult with a qualified healthcare provider or registered dietitian before making significant changes to your diet or if you have any health concerns.

7.3 Service Availability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Calk and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or other intangible losses
• Damages resulting from reliance on nutritional information provided by the App
• Damages resulting from unauthorized access to your data
• Any interruption or cessation of the Service

In no event shall our total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Calk and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your use of the Service at any time by deleting the App from your device.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Calk operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calk regarding your use of the Service and supersede all prior agreements and understandings.
